US99.5 “Meijer Modern Warfare Game Giveaway”

 

 

 

The “WUSN Meijer Modern Warfare Game Giveaway Contest” (the “Contest”) will begin on November 9, 2009 at approximately 10:00 pm Central Time (“CT”) and end at approximately 12:00 am CT on November 10, 2009 (the “Contest Period.”)

 

To participate in the Contest, you may enter by the following method: go to the WUSN appearance at Meijer located at 1251 Golf Rd. in Rolling Meadows, IL beginning at 10:00 pm CT on November 9, 2009 to obtain and fill out an official entry form, available on location while supplies last. Complete an entry form including first and last name, complete address, city, state, zip code, daytime telephone number and date of birth and place the entry form in the Xbox 360 or Playstation 3 drop boxes or hand the entry to the appropriate WUSN representative. All entries must be received by 11:55pm CT on November 9, 2009. 

 

One (1) entry per person. No photocopies or mechanically reproduced entries will be accepted.

WUSN and the participating sponsors of this Contest (hereinafter collectively referred to as the “Sponsors”) assume no responsibility whatsoever for any lost, misdirected, illegible, stolen, incomplete, mutilated, or late entries. All entries become the exclusive property of the WUSN and will not be returned.

 

The Contest is open to those who reside in the Chicagoland Area and Northwest Indiana, and are 18 years of age or older at the time of entry. Employees of  Meijer, WUSN (the “Station,”) their licensee, corporate parents, subsidiaries and affiliates, their advertising agencies, participating sponsors/promotional partners, and other radio stations in the Chicagoland area andthemembers of their immediate families and/or are ineligible to participate or win.   Subject to all applicable federal, state and local laws and regulations.

 

Entry into the Contest constitutes your agreement to be bound by these Official Contest Rules.

 

Winners will be required to provide valid government-issued photo identification and sign and return any required Affidavit of Eligibility and/or Liability/Publicity Release in order to claim prize.

 

 

 

c)   There is no substitution, transfer, or cash equivalent for prizes, except that Station may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.

 

 

a)  Decisions of Station management with respect to the Contest are final.

 

b) Five winners will be selected in the following manner:

 

Three (3) winners will be selected on November 10, 2009 at 9:00am CT in a random drawing of all eligible entries received by the entry deadline. Each of these three winners will receive one (1) Call of Duty: Modern Warfare 2 Game for Xbox 360. Winners from this drawing will be selected from the entries in the Xbox 360 drop box that was displayed onsite during the contest period.

 

Two (2) winners will be selected on November 10, 2009 at 9:00am CT in a random drawing of all eligible entries received. Each of these two winners will receive one (1) Call of Duty: Modern Warfare 2 Game for Playstation 3. Winners from this drawing will be selected from the entries in the Playstation 3 drop box that was displayed onsite during the contest period.  

 

d) Odds of winning depend upon the number of eligible entries received.

 

 

 

Winners must execute and return any required affidavit of eligibility and/or liability/publicity release within ten (10) days of winning or prize will be forfeited and no alternate winner will be chosen from the remaining entries.  If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, potential winner forfeits prize.

 

a)      Entry into the Contest and acceptance of a prize constitutes permission, unless prohibited by law, to use the winner’s name and guest’s name, voice, or likeness in any advertising or broadcasting material relating to this Contest without additional financial or other compensation. 

 

b)      Payments of all federal, state, and local taxes are solely the responsibility of the winner. Winners may be required to sign a W-9 IRS Form with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize.

 

c)      By entering into the Contest and accepting a prize, the winners (and their guest, if any) agree that the Sponsors, their parents, partners, subsidiaries, and affiliated companies, their respective agents, employees, directors, officers, shareholders and legal advisors and any other companies participating in the design, administration, promotion, advertisement or fulfillment of the Contest (hereinafter collectively referred to as the “Contest Entities”), shall not be liable for personal injuries, death, damages, expenses or costs or losses of any kind resulting from participation or inability to participate in the Contest or acceptance of or use or inability to use the prize(s) or parts thereof including, without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. The winners release the Contest Entities from any and all liability and responsibility with respect to any prize (including any property loss, damage, personal injury or death).

 

d)     Prior to awarding any prize or prize certificate, the Station, in its sole discretion, may require Contest winners (and their companion(s), if any) to sign a liability release agreeing to hold the Contest Entities, the Station, its corporate licensee, its parent, subsidiary and affiliated corporations and the officers, shareholders, directors, employees, agents, and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Contest.

 

e)      The Station reserves the right to make changes in the rules of the Contest, including the substitution of a prize of equivalent value, which will become effective upon announcement.  If due to circumstances beyond the control of the Station, any competition or prize-related event is delayed, rescheduled, postponed, cancelled, or has a change of venue, the Station reserves the right, but not the obligation, to cancel or modify the Contest and shall not be required to award a substitute prize.

 

f)       Failure to comply with the Official Contest Rules may result in a contestant’s disqualification at the sole discretion of the Station.

 

g)      The Station is not responsible for typographical or other errors in the printing, the offering, or the administration of the Contest, or in the announcement of the prizes.

 

h) Copies of the written Official Contest Rules and a list of winners are available (when complete) during regular business hours at the main office of US99.5, Two Prudential Plaza, Suite 1000, Chicago, IL, 60601, by sending a self-addressed stamped envelope to WUSN or by logging on to www.us99.com/contests.shtml.
