1. HOW TO ENTER:
A. The US99.5 Aquapalooza Giveaway (the “Contest”) entry period will begin on 6/29/2009 at 12:00AM Central Time (“CT”) and end on 7/3/2009 at 12:00PM CT (the “Contest Period”). The Contest will end when the winner is selected at approximately 12:15 pm CT on 7/3/09.
B. To participate in the Contest, you may enter via the following methods:
Between 6/29/2009 at 12:00AM CT and 7/3/09 at 11:59AM CT, text the promotional code “AJ” to the US99.5 short code ‘287995’. Any entry received outside of the Contest Period will be ineligible. Standard text messaging rates apply to each text message sent or received, including error messages. You will be charged for each text message sent or received according the terms of the service agreement with your wireless carrier. Proof of text message sent does not constitute proof of receipt.

Between 6/29/2009 at 12:00AM CT and 7/3/09 at 11:59AM CT log onto www.us99.com, click on the “Contests” page link, and click on the “Aquapalooza” contest link. Enter your first and last name, complete address, city, state, zip code, home telephone number, date of birth, and a valid email address in the online entry form. Only one (1) Internet entry per email address is permitted. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an Internet access provider, online service provider or other organization that is responsible by assigning email address or the domain associated with the submitted email address. For purposes of these Official Contest Rules, “receipt” of an online entry will be solely determined when the Station’s web servers record the entry information. Any automated computer receipt (such as one confirming delivery of an email) does not constitute actual receipt of an entry for purposes of these Official Contest Rules. Multiple participants are not permitted to share the same email address. All entries submitted become the sole property of WUSN and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by WUSN. WUSN’s computer is the official time keeping device for the Contest.
C. All entries must be received by 11:59AM CT on 7/3/09. WUSN is not responsible for entries not received due to difficulty accessing the Internet, service outage or delays, computer difficulties or other technological glitches. In addition, WUSN is not responsible for telephone service outages, delays, busy signals, equipment malfunctions and any other technological difficulties that may prevent an individual from sending a text message. Limit one (1) entry per person per day per entry method.
2. ELIGIBILITY AND RESTRICTIONS:
A. The Contest is open to all listeners who are 21 years of age or older and reside in the Chicago Metropolitan area, Employees of WUSN (the “Station”), its licensee, its corporate parents, subsidiaries, and affiliates, its advertising agencies, participating sponsors/promotional partners, other radio stations in the Chicago metropolitan area and the members of their immediate families and/or households are ineligible to participate or win. Subject to all applicable federal, state, and local laws and regulations.
B. Winner must present valid government-issued photo identification, and must sign and return all required Affidavits of eligibility and/or liability releases in order to claim prize.
C. Contestants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and the Station will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.
3. PRIZES:
A. One (1) prize will be awarded. The prize includes round-trip airfare for two from Chicago to Birmingham, AL including lodging at Lake Martin (one standard room), details to follow [State details before contest beings. i.e., complete address of location, arrival and departure airports, etc.], and ground transportation while in Alabama from 7/24/2009 to 7/26/2009, Water transportation [Specify the type of water transportation] to and from the AJ show, entrance onto the floating AJ “Party Barge” and a meet and greet with Alan Jackson. Approximate Retail Value (ARV): $3000.00 but may vary depending on fares in effect at the time travel is booked. Winner will not receive difference between actual and approximate retail value. Certain travel restrictions may apply. If winner cannot travel on dates specified, winner forfeits prize and an alternate winner may be selected, time permitting and at the sole discretion of Station, in a random drawing or all remaining entries. All other costs not specifically stated herein, including, but not limited to, taxes, meals and tips, are the responsibility of the winner. Winner may be required to present a valid credit card upon hotel check in to cover any incidental expenses incurred during their stay. Travel companion of winner must also be at least 18 years old or accompanied by a parent or legal guardian. Winner and travel companion must travel on the same itinerary and are responsible for obtaining all required travel documents. Grand Prize Winner and travel companion are responsible for obtaining travel insurance (and all other forms of insurance) where applicable, at their option, and hereby acknowledge that the Station has not and will not obtain or provide travel insurance or any other form of insurance. Winner and travel companion must sign a Publicity, Liability Waiver and Travel Release form prior to traveling.
If a selected event is unable to take place as scheduled, for reasons such as cancellation, preemption, postponement or unavailability, or for any reason beyond the control of the Station, the Station’s sole responsibility to the winner will be to award the remaining available portion of the prize and no substitution will be provided for unawarded portion of prize. Tickets are subject to terms and conditions as specified by issuer. Seat locations to be determined by prize provider. Prize provider reserves the right to remove or to deny entry to winner and/or guest if he/she engages in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the event.
B. All prizes or prize certificates may be picked up at the office of the Station, at the address below. The winner will forfeit any prize or prize certificate not claimed within 5 days of winning. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. The Station is not responsible for the safe arrival of a prize or prize certificate.
C. There is no substitution, transfer, or cash equivalent for prizes, except that Station may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
4. WINNER SELECTION AND NOTIFICATION
A. Decisions of the Station management with respect to the Contest are final.
B. One (1) winner will be selected on 7/3/09 at approximately 12:15PM CT in a random drawing from the pool of all eligible text message entries and online entries received during the Contest Period.
C. Odds of winning depend on the number of eligible entries received by the end of the Contest Period.
D. Winners need not listen or be present to win.
E. Winners will be contacted by phone by the Station on 7/3/09 at or around 12:15 p.m. CT. If any winner cannot be contacted within five (5) days of the initial notification attempt, that winner forfeits prize and an alternate winner will not be selected. Winners must execute and return any required Affidavit of Eligibility/Release of Liability Prize Acceptance Form within five (5) days of notification or prize will be forfeited and an alternate winner will not be selected.
D. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, potential winner forfeits prize.
5. CONDITIONS:
A. Payments of all federal, state and local taxes are solely the responsibility of the winner. Winner will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize.
B. By participating in the Contest, winner and guest agree to have his/her name, voice, or likeness used in any advertising or broadcasting material relating to this Contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
C. Prior to awarding any prize or prize certificate, the Station in their sole discretion may require Contest winner and guest to sign a liability release, agreeing to hold the Station, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Contest.
D. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the Station’s website or is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the Contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
E. The Station reserves the right to make changes in the rules of the Contest, including the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event is delayed, rescheduled, postponed, cancelled, or has a change of venue, the Station reserves the right, but not the obligation, to cancel or modify the contest and shall not be required to award a substitute prize.
F. Failure to comply with the Contest rules may result in a contestant’s disqualification solely at the discretion of the Station.
G. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Contest, or in the announcement of a prize.
H. Copies of the written Contest rules and name of winner are available during regular business hours at the main studio of WUSN at 180 N. Stetson, Suite 1000, Chicago, IL 60601.
