1. HOW TO ENTER
a. The “US*99.5/Outback Steakhouse Gift Card Giveaway 2008 Website Contest” (the “Contest”) will begin on July 16, 2008 at 12:00 A.M Central Time (“CT”) and end on Friday, July 25, 2008 at 12:00 P.M. CT (the “Contest Period”).
b. To participate in the Contest, you must enter via the following method: Beginning on July 16, 2008 at 12:00 A.M., log onto www.us99.com, and click on the “Contests” page link, and click on the “Outback Steakhouse Gift Card Giveaway 2008” link. To enter, fill out the official entry form with your first and last name, complete address, city, state, zip code, home telephone number, date of birth, and a valid email address in the online entry form. Only one (1) Internet entry per person and one (1) Internet entry per email address are permitted. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an Internet access provider, online service provider or other organization that is responsible by assigning email addresses or the domain associated with the submitted email address. All entries submitted become the sole property of WUSN and will not be acknowledged or returned. For purposes of these Official Rules, “receipt” of an online entry will be solely determined when the www.us99.com web server records the entry information. Any automated computer receipt (such as one confirming delivery of email) does not constitute actual receipt of an entry form for purposes of these Official rules. Use of any device to automate entry is prohibited. WUSN’s computer is the official time keeping device for this Contest.
c. WUSN is not responsible for entries not received due to difficulty accessing the Internet, service outage or delays, computer difficulties or other technological glitches.
d. All entries must be received by 12:00 P.M. CT on July 25, 2008.
2. ELIGIBILITY RESTRICTIONS
a. The Contest is open to all persons who are 18 years of age or older and reside in the Greater Chicago Land Metropolitan Area in Illinois, Indiana and Wisconsin. Employees of WUSN (FM) (the “Station), its licensee, CBS Radio Inc., CBS Corporation, subsidiaries and affiliates, its advertising agencies, participating sponsors/promotional partners, other radio stations in the Greater Chicago Land Metropolitan Area in Illinois, north-west Indiana and southern Wisconsin and the members of their immediate families and/or households are ineligible to participate or win. Subject to all applicable federal, state, and local laws and regulations.
b. Listeners are eligible to win a Station contest only once every sixty (60) days.
c. Winner must provide government issued photo ID and sign and return any required Affidavit of Eligibility and/or Publicity/Liability Release prior to receiving the prize.
d Contestants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and the Station will also delete any entry received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.
3. PRIZES
a. Ten (10) prizes will be awarded. Each prize is one (1) $45.00 gift card to Outback Steakhouse [Is this valid at all locations? If so, please add that “Valid at all locations” to this section. If not, please indicate at what locations the prize is valid]. Approximate Retail Value =$45.00.
b. Winners will be subject to the terms and conditions of the gift card as set forth by its issuer. Winners will forfeit any prize or prize certificate not claimed by 12:00 P.M. on July 25, 2008 [This date is incorrect. Please revise. The date should allow sufficient time for the winners to claim their prize]. In the event that a prize or prize certificate is mailed, the winner assumes the risk of its loss. The Station is not responsible for the safe arrival of a prize or prize certificate.
c. There is no substitution, non-transferable, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
4. WINNER SELECTION AND NOTIFICATION
a. Decisions of Station management with respect to the Contest are final.
b. On July 25, 2008 at approximately 12:00 P.M. CT, members of the US 99.5 Promotions Department will select ten (10) winners in a random drawing of all eligible entries received by the entry deadline.
c. Odds of winning in part depend on the number of eligible entries received.
d. Winner need not listen nor be present to win.
e. The winner will be contacted by the Station Promotions Department by phone following the drawing. If the winner cannot be contacted within one (1) day of the first notification attempt, the prize will be forfeited and an alternate winner will be selected in a random drawing of all remaining eligible entries. Winner must execute and return any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance by 12:00 P.M. on June 25, 2008 [This date is incorrect. Please revise. The date should allow sufficient time for the winners to stop by the station and sign the forms] or prize will be forfeited and an alternate winner [Insert one of the following: “will be selected in a random drawing from all remaining eligible entries received” or “will not be selected”]
5. CONDITIONS
a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners may be required to sign an IRS Form W-9 or the equivalent. Failure to provide and accurate and complete SSN, if required, is a violation of federal law and will result in forfeiture of prize.
b. By participating in the Contest, the winners agree to have their names, voices, or likenesses used in any advertising or broadcasting material relating to this Contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, the Station in its sole discretion may require Contest winners, to sign a liability release, agreeing to hold the Station, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Contest.
d. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the Station’s website or is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the Contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
e. The Station reserves the right to make changes in the rules of the Contest, including the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize related event is delayed, rescheduled, postponed, cancelled, or has a change of venue, the Station reserves the right, but not the obligation, to cancel or modify the Contest and shall not be required to award a substitute prize.
f. Failure to comply with the Contest rules may result in a Contestant’s disqualification, solely at the discretion of the Station.
g. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Contest, or in the announcement of a prize.
